Artly Artist Agreement

1. Curation, not employment. Listing your work on Artly does not make you an employee or partner of Artly. Artly acts as a curator and marketplace that introduces your work to buyers. You keep ownership of your work and may sell works that Artly did not introduce you to through any channel you like — but sales that come through Artly are subject to Sections 2 and 4.

2. Commission. Artly charges a commission on every sale facilitated or introduced through the platform, at the rate published in your account terms at the time of sale. Promotional discounts, where offered, are funded from Artly's commission and never reduce the amount you receive.

3. Your work, your rights. You keep full copyright and ownership of every work you list. By submitting a work you confirm it is your own original creation (or that you hold the rights to sell it) and that the images and details you provide are accurate.

4. No circumvention. (a) A buyer who first discovers or contacts you through Artly is a "Platform Buyer." (b) For 12 months after that first contact, sales to a Platform Buyer of works listed on Artly, or works substantially similar to them, must be completed through Artly and are subject to commission. (c) You will not move a Platform Buyer off the platform, or share personal contact details (phone, email, social handles, external links) for that purpose, to complete a sale outside Artly and avoid commission. (d) This does not restrict buyers you found independently of Artly. (e) Breach may lead to suspension or removal from the platform and to liability for the commission that would otherwise have been due.

5. Inquiries and fulfilment. Artly does not currently process payments. When a Platform Buyer inquires, Artly passes their message to you and the sale proceeds on the platform under these terms; you remain the seller of record, responsible for authenticity, packaging and delivery. Keeping the transaction on Artly under Section 4 applies.

6. Account and profile. You are responsible for keeping your account credentials secure and your profile accurate. Artly may suspend an account that violates these terms or misrepresents a work's authenticity.

7. Ending this agreement. You may stop listing new work or request removal of your profile at any time. The Section 4 obligations survive for the stated 12-month period as to Platform Buyers. Artly may end this agreement for cause with notice where practicable.

8. Changes. This agreement may be revised as the platform develops. Where a change is material, we will ask you to review and accept the updated version.

9. Governing law. This agreement is governed by the laws of the State of Israel; disputes are subject to the competent courts of Tel Aviv.
